Terms of service and acceptable use policy

Hostizzle.com (hereinafter called “Hostizzle”) is an Internet Service Provider (ISP). Using our services, all clients will be offered the means to send and receive information on the internet.

The Policies of Acceptable Use (AUP) has been developed by Hostizzle for the purpose of protection of competing interests. Certain terms of every customer’s respective service agreement will be supplemented and explained in AUP.  AUP is a guideline of customers’ rights and obligations when utilizing the service of Hostizzle.

The AUP will be revised from time to time.  At any time, users’ use of Hostizzle.com’s website or VPN service will be understood to indicate acceptance of the current AUP.

Note that Hostizzle does not take responsibility for any information created by its users.  Hostizzle does not store any actual user content on any of its servers. The service is solely provided to send and receive a particular data stream once.

Forbidden Activities

Hostizzle is designed to keep people safe and secure online, and to enhance the privacy of users online.  We have a “zero tolerance policy” towards any use of Hostizzle for illicit purposes.  Violations of the policy of Hostizzle are listed below, but not necessarily limited to the examples cited.  These policies apply to Hostizzle users, customers, affiliates, or subsidiaries. Violation of these policies will lead to immediate termination of a user’s VPN account, with no refund.

1. Spamming: the sending of unsolicited bulk and/or commercial messages through the Internet is forbidden on Hostizzle servers.  Additionally, maintaining an open SMTP relay is forbidden. Once a complaint is sent to Hostizzle, Hostizzle will use its discretion to determine from all evidence regardless of whether the e-mail recipients are from an opt-in e-mail list. 2. Forging of Headers:  the cutting or misrepresenting of message headers that can be either in whole or in part. This action tries to hide the originator of the message.

3. Illegal or Unauthorized Access to Other Computers or Networks: also known as hacking. This activity will include any accessing without authorization computers, accounts, or networks belonging to another party, or attempting to penetrate security measures of another individual’s system. Furthermore, any activity which is done as a precursor to an attempted system penetration, for instance, port scan, stealth scan, or other information gathering activity will be deemed to be illegal or unauthorized access under this item.

4. Distribution of Internet Viruses, Worms, Trojan Horses, or Other Destructive Activities.  We forbid any distribution of Internet viruses, worms, Trojan horses, pinging, flooding, mail bombing, or denial of service attacks. Additionally, any activities disrupting the use of or interfering with the ability of others to effectively use the network or any connected network, system service, or equipment will be deemed to be this violation.

5. Facilitating a Violation of this AUP: any advertisement, transmission, or otherwise any available software, program, product, or service designed to violate this AUP, including the facilitation of the means to spam, initiation of pinging, flooding, mail bombing, denial of service attacks, and piracy of software) will be deemed to be a violation under this activity.

6. Copyright violation.  This site operates in America under the “safe harbor” provisions of the DMCA.  All DMCA complaints should be forwarded to our DMCA Designated Agent, information below.  We do not have any knowledge of the content our users are producing or accessing over our VPN, nor do we take any responsibility for content.  Having said this, we will not knowingly facilitate copyright violations on our site.  We will deal with copyright violators according to established ISP practices, including warning offenders and revoking access to habitual violators.  The main use of VPN software is to facilitate individual freedom and liberty online, and not to circumvent copyright.

7. Other Activities: this will means any activity (lawful or unlawful) which are determined by Hostizzle as harm to the Hostizzle’s users, operations, reputation, goodwill, or customer relations.

As a result of the above forbidden activities, Hostizzle shall reserve the right to terminate the privileges of users and customers who commit violations of Hostizzle policy and service agreements.  Hostizzle also intends to cooperate with law enforcement authorities conducting any criminal investigations of online user activities.

Considerations of Privacy and Security
The Privacy of on-line communications and web sites is an important issue that Hostizzle is deeply concerned with. It cannot be guaranteed that other means of communications (e.g. mail, facsimile, and voice telephone service) will ever be 100% secure. And therefore, we always recommend using common sense.

In case any client has a complaint about a client’s violation of this AUP, the e-mail should be sent to hostizzle@gmail.com

Notification. Pursuant to the applicable laws of the United States of America, a copyright owner or its authorized agent may submit a notification alleging copyright infringement to Hostizzle, if the complainant has a good-faith belief that its works are being infringed upon by material under Hostizzle’s control.

Use of this web service, the VPN servers, or any contact with the hosting provider implies consent to the above terms.

Information Which We Collect
Hostizzle.com only collects your sign-up information, email, your login and logout times, bandwidth usage, and the duration of your connection when using the VPN service.

For premium users (paid) this also includes your payment details such as name and billing cycle details as explained below under our log keeping policy.

Use Of Collected Information
Hostizzle.com will only ever use personally identifiable information collected through our web site to contact users regarding only products and services offered by Hostizzle.com We will NOT share this information with anyone. Period.

Our system only monitors if users are having connection problems or connection drops so that we can improve our services to you.

Maintenance of Information
Information about users that is maintained on our systems is protected using industry standard security measures.

Hostizzle.com’s Log Keeping Policy
As a matter of course, we do not monitor, record or store logs of any single customer’s activity on our network (not that we even could, since the connection is encrypted).

With that said, we do log the following for billing and security purposes:
1. Connection date & time
2. Bandwidth usage

Salient points regarding our logging policy:
1. These logs are not kept for any lengthy period of time.
2. These logs are used only to track abuse of our service by users who might wish to use their connection in order to engage in illegal activity such as hacking, credit card fraud, spamming, etc.
